The judge said that Frank Figliuzzi’s statement, “when taken in context, cannot have been perceived by a person of ordinary intelligence as stating actual facts about Patel.”

A federal judge in Texas has tossed a defamation suit brought by FBI Director Kash Patel against former FBI assistant director-turned-MSNBC contributor Frank Figliuzzi.

Patel had sued Figliuzzi over comments he made on “Morning Joe” about the FBI director’s evening activities.

“Yeah, well, reportedly, he’s been visible at nightclubs far more than he has been on the seventh floor of the Hoover building,” Figliuzzi said on the show last year.

      This is because USA is one of the few countries in the world that doesn’t have loser pays laws. He should have to pay MSNBC’s legal fees.

        We have “loser pays” contracts and “loser pays” countersuits.

        “Loser pays laws” can also inhibit individuals from filing legitimate lawsuits in the first place out of fear.

        It’s not automatic, but MSNBC can sue to recover those fees. However, it’s still a pretty high bar.

      I’m excited to see what discovery in his defamation suit against The Atlantic will reveal about his conduct (should it go to trial).

      This asshat is out there trying to bully media outlets into silence, probably not realizing the hilarious backfire waiting for him when one of them calls his bluff and lets a court verify their allegations 😄

    The fact that it was thrown out I knew it was not Judge Kacsmaryk, but the fact that I still checked makes me sad I felt like I had too.
