If he was not in the state, that doesn’t disprove he was MS13, which as far as I can tell is what this is all hinging on. Legally speaking though it is on the judge to show sufficient evidence for their ruling. If they couldn’t get the state he was in right that does call into question the rest of his judgement about him being MS13.
