Most legal experts thought that this Trump order to take birthright citizenship away from undocumented immigrants was too radical for even this Court. But the margin was ultimately very thin. Kavanaugh concurred with the judgment only insofar as he thinks the executive order violates a law (that Congress could change). He wrote that the order did not violate the 14th Amendment. So the split in terms of the finding that curtailing birthright citizenship violates the Constitution is a bare 5-4.

    Clown court. It’s clear as day that it is directly afforded in the constitution. How the dissenters don’t all get dragged out of their homes is a mystery only adequately explained by a shared pacifistic nihilism.

    Is it only apply to both parents or just one parent? If only parent then wouldn’t Baron Trump not be a citizen anymore?

      They made a tactical decision to delay. The opinions make it clear that 5 justices want to do away with birthright citizenship, but only 3 want it to happen right this instant
