  • There is criminal, not civil courts, that were sucessfully drowned in the cum-ex robberies. They gave up on prosecuting people who stole billions from the federal budget, because they were unable to process the amount of files brought by the defense, before the statue of limitations expires.

    So if even prosecuting theft of billions of Euros is subject to this tactic smaller civil cases can be too. And the court, because of their lack of technical understanding struggle to assess which files are relevant and which aren't.

  • I had an argument with some blog poster here recently, who tried to compare the US and EU based on how neoliberal the economic policies are. But the difference in economic growth was then attributed to these policies, ignorinh the underlying structural factors.

    Unfortunately i rarely see articles like this one, that adresses the structural aspects. Overall population and working population are key factors to economic growth. The US population grew siginificantly over the past two decades, while European populations only grew minimally or stagnated.

    If the reactionary and liberal politicians in the EU blame the overall slower growth of the economy compared to the US on labor rights, social systems or public companies they deflect from how their restrictive immigration policies are the main factor why the US can grow faster economically.

  • Because those talking points revolve around the idea of an ethnically homogenous Europe/Nation that is in davger of being "conquered" by inferior races that have to be deported or murdered to prevent this alleged conquest.

    It is genocidal ideology and as such is both in clear violation to the constitution and a danger to the democratic order.

    The point is that their ideology gives way to murderous violence.

  • Yeah. This is going to be noticed in Tech blogs and news sites, but it wont make it to the mainstream news. Even if some mainstream newspaper might notice it and want to write a small article about it, they most likely will repeat the corporate response about some evil hacker messing with their product.

  • The problem is that it can still work in Germany to just pile the defendant under too many files to process with his ressources. This is not the case in stuff that courts understand, like say a traffic accident. But for anything technical/IT/IP related German courts are terribly incompetent and unable to create a fair case.

    Especially regarding IP related things like streaming or torrenting movies, there is a myriad of ridiculous court decisions. The default unfortunately seems to be to just assume the corporation to be in the right, because it is a corporation and surely they must own the IP and lose a lot of money from the evil hackers.

    It is classic Nazi rhetoric and uses the same scapegoat that Anders Breivik used to justify the mass murder of more than 70 teenagers in Norway.

    Also if it would be ruled that the party in its entirety does not justify a ban yet, but its local branches that do, would get banned, that would effectively destroy them too. Also other measures that could be deemed appropriate, like blocking their funds, banning various associated organizations etc. would all help.

    Meanwhile i dont think there is anyone, who likes their fascist ideology, but doesnt vote for them on the basis of uncertainty, about their democratic legitimation. Nobody that follows fascist ideology cares about democratic values or the constitution.

  • Well there is single battles aka fighting, and there is the war as an armed conflict as a whole.

    A succesful siege, while brutal to the besieged, falls under the quote, as the enemy is subdued without a fight

  • And yet they don't want to initiate the procedure to ban the fascist party.

    Most of the supposedely democratic parties in Germany currently work either as "Steigbügelhalter" the guy who holds the horse saddle stirrup, for the lord to get on. Or they work as "Totengräber" the grave diggers of democracy, by standing by idly and accepting the loss of democratic principle and creating social and economic situations that fuel the fascists propaganda.

    Instead we could focus on the corrupt politicians, rather than ousting entire people and have them become Putin allies for certain.

  • I meant they can block the passing of laws. They can kill civil society actors by denying funds on the muncipal level, like organizations against hate crime or artists, museums and other institutions that are critical of fascist politics. They can stack muncipal administrations, police, and state executive branches with their own people.

    If they gain power in the states, they can block some federal legislation, fuck up state legislation and of course they will always blame it on the federal politics.

    If they gain power in the muncipalities, they can effectively block the implementation of federal and state legislation and create fascist control on the local level.

    Also as education is handled on state level, they can rearrange the teaching of history, ethics, religion and other subjects, to follow their ideology.

    Even if a banning procedure is initiated then, it is much more difficult to get rid of them and repair the damage they have done by then, than if the government would act now.

    I disagree with this argument though. Nobody that feels aligned with the positions of the AfD or is fenerally against democracy will not vote them necause they might be illegal. Instead i often see and hear the argument their positions are legitimate as theyd otherwise be forbidden.

    They simply do not derive their voting potential from people who care for rational consideration. The AfD works by emotionalizing and deceiving.

    So it wont get much worse if the court case should fail. Also it is not something that was empirically observeable with other failed cases of forbidding parties in Germany.

    On the other hand it might very well be too late after this years elections as the AfD could take over state governments, have enough power in many muncipal governments and in the Bundesrat (federal council) to block everything from moving forward. They do not lose politically from things not working. Instead they win even more and can radicalize even more. Also if they take power over state polices, prosecutors and the interior intelligence, it will be impossible to collect more evidence on their fascist and anticonstitutional activities.

    What we see now is similiar to the appeasement we saw in the 30s. It is weak minded politicians reluctant to take action. But this doesnt work with fascists. There is never enough for them. They will always become more radical, more violent and more powerhungry.

  • In the EU the avg water consumption per person and day is 144 litres. So the 448 Million EU citizens use about 64 Million m3 or Tonnes of water.

    In other words Greenland loses about the same amount of water as ice in two hours, like all the EU citizens use in a day.

    The revelation last week has caused an uptick in demonstrations against the AfD and fascism in Germany. Many people are now demanding that the government should initiate a case to ban the AfD at the constitutional court. A case to ban a political party can only be initated by the federal government, the federal parliament, or the federal council.

    However multiple high ranking politicians has argued against forbidding the AfD, claiming to "fight them with arguments" instead. Calls like this came from Friedrich Merz, the leader of the conservative/right wing populist CDU, Markus Söder, the head of the right wing populist CSU, Christian Lindner, head of the liberal party FDP and current minister of Finance. CDU and FDP voted together with the AfD in 2020 to make the FDP candidate prime minister of Thuringen for one day, despite the FDP having barely 5%, which is the minimum for a party to sent delegates to a parliament in Germany. The subsequent government crisis lead to the AfD now being the strongest political force in Thuringen, according to election polls. CDU and FDP also worked together with the AfD on the local level before. Among other things they limited the amount of refugees a city would house and cut funding to organizations, who help and represent victims of hate crime.

    The head of the AfD in Thuringen Björn Höcke lost a defamation lawsuit, because the court ruled, that "fascist" is a factual description of him, rather than an insult. Multiple state organizations of the AfD are considered proven to be far right extremists by the interior intelligence, as well as the youth organization of the party. All of the party is considered to be suspect of being far right extremists.

    Germany is facing the risk of a another fascist power grab, yet parties that claim to be liberal and conservative refuse to defend the democracy against them, likely hopeing for their own power options under a fascist government, as well as being worried of backlash for having helped the AfD by repeating and strenghtening their political positions and topics.

    The fast wind was moving more or less straight. Now that it slows down, it gets a wavy pattern, that also moves slower. As a result we get more stable cold zones and more stable heat zones.     In Southern Europe it is economic turmoil, in eastern Europe it is Russian agression, in some areas of western and central Europe it is climate change and in other areas it is migration. Finally there is the Covid, which is an issue in all countries.

  • This reminds me of the debate regarding racism, fascist extremism and violence in the German police. Whenever something happened it was deflected by politics as an "Einzelfall" a solitary occurence. When you keep seeing what you call "micro events" you should look into the underlying pattern.

  • The claim that anti-semitism is hidden under anti-zionism is used extensively in Germany, often to muddy the water and not deal with legitimate anti-zionism on a factual basis. This is done deliberately, both instrumentalising jewish people, that might want nothing to do with Israel and attacking jewish people that voice criticism of Israel. Both dimensions of this are anti-semitic as they deny jewish people a position and voice outside of the context of Israel.

    If you read the analysis on the antisemtism officers in Germany you will see, that this is not a pattern that only came into existence with the current protests, but a systemic issue in Germany, which is deliberately caused. The article in the jewish currents was published in July, almost three month before the Hamas attacks of 07. October.

    It is true that some use anti-zionism as a platform to promote anti-semitism, but it is impossible to have a proper debate about it and differentiate these two in Germany. Also mixing them up like this prevents the possibility from identifying anti-semitism that could be prevented by honestly educating people about the differences and lines to it. But if for instance demonstrations in Germany are banned by default, students in schools are punished for bringing Palestinian flags and similiar persecutions occur, it is difficult to challenge anti-semitic prejudice like jews secretely exerting power on other countries. By blaming all anti-zionist positions to be anti-semitic, it also creates a reaction of defiance, where people feel inclined to take on anti-semitic positions, as they are labeled anti-semitic either way, even if voicing legitimate criticism of Israel.
