It has always been broken. The Civil War was in part triggered by business-friendly SCOTUS judges who ruled that the Missouri Compromise was unconstitutional. That set off the killing of hundreds of thousands of people.
Personally I believe that they were forced into it, kicking and screaming, and they wanted to make it painful. They didn't care who got hurt, only that someone did get hurt.
I’ve never managed to develop one. I’ve gone many times down the “oh that looks interesting” only to quickly become bored path so I gave up on trying to adopt one. I focus on making my day less boring.
